EEO Executive Council Meeting
Held Tuesday, October 26,
2004
Ms. Delia L. Johnson,
Co-Chair and Director, Office of Civil Rights for International Broadcasting
Bureau, opened the meeting with a few remarks and then asked the attendees to
give their name, agency, and position.
She thanked Bonita White, Director, EEO Programs, DHHS, for sponsoring
this meeting.
Ms. Johnson indicated that she and Mr. Jorge Ponce had served for two consecutive terms as Council Co-Chairs (from 2001-2004). Consequently, the Council Charter barred them from running for a third term.
Mr. Felton Page, Chief, NGB-EO, National
Guard Bureau, introduced a motion to amend the Council charter in order that
Ms. Johnson and Mr. Ponce could serve another term. Ms. Cheryl Prejean Greaux, Director, Civil Rights Staff, USDA/
Rural Development, seconded the motion.
Ms. Bonita White, who with Charles Miller chaired the Nominating Committee, explained that only Council members who had attended at least fifty percent of the Council meetings during the pertinent 2-year period could vote in Council elections. Moreover, she indicated that candidates running for office must have attended at least fifty percent of the Council meetings during the pertinent 2-year period. Mr. Ponce stated that this information was verified by checking the attendance sheets of Council meetings. Therefore, he emphasized the importance for Council members who sent designees to these meetings to sign the attendance sheet by indicating that they were attending on their behalf.
Ms. White wanted to
introduce a motion to amend the Council charter by putting a time limit on the
maximum years that a Council member could serve as an officer. Mr. Felton Page introduced a motion to
change the length of time that any Council member could serve from two years to
four years, which Ms. White seconded.
Ms. Johnson stated that Ms.
Era Marshall had only served one term as Vice-Chair and was eligible to run for
a second term. When asked, Ms. Marshall
agreed to serve a second term.
Ms. Johnson indicated that
there were vacancies for a Co Vice-Chair (the other Vice-Chair, Ana Ortiz,
recently retired) and a Secretary.
The next election results
will take place at the November 2004 meeting, and the results will be announced
at the December 2004 meeting.
A Council
member asked whether the Council guest speakers discussed only Title VII
matters. Ms. Johnson clarified that
this was not the case, and that in the past, speakers had addressed the Council
on Title VI and IX issues.
Ms. Johnson
suggested that it would be a good idea to get a sponsor(s) to host an EEO
summit during the spring of 2004.
Mr. Ponce
indicated that he and Ms. Johnson had made presentations at the last NAACP Town
Hall Meeting.
Ms. Johnson
recommended that agencies should verify that their No Fear Act postings for the
FY 04 complaints activity matched the figures included in the last 462
Report.
Ms. Era Marshall
suggested inviting an OPM speaker to address the next Council meeting on Title
I and II of the No Fear Act, and Mr. Ponce volunteered to contact OPM on this
matter.
Ms. Bonita White
and Ms. Linda Bradford offered to share with Council members the HHS and HUD
policies for the reimbursement provision of the judgment fund per Title II of
the No Fear Act.
Ms. Era Marshall
mentioned an important class-action lawsuit dealing with white attorneys at the
U.S. Department of Justice who had claimed non-selection for jobs because of
their gender and skin color. The
lawsuit was settled recently for $11.5M.

MiCroPact Presentation
Mr.
Evesity, which is currently being used by more than 55 federal
agencies, provides workforce analysis, barrier identification, management and
reporting required by MD 715. It allows an agency to perform extensive
statistical analysis comparing benchmarks, such as the 2000 Census data. Eversity
also provides a robust plan generator and plan management console. One of
its most popular features is the capability to generate a complete set of data
elements and on-screen formatting for EEOC Form 715 Parts A-J and Tables A1-A14
& B1-B14. Under Eversity standard maintenance, MicroPact will
continue to keep the software compliant with all MD-715 updates
automatically. Eversity already has incorporated the new EEOC job
categories. MicroPact has the software to resurvey agencies’ workforces
to bring them in compliance with the new RNO categories specified by
MD-715. To protect the confidentiality of the data, Eversity
relies on user name, passwords, and roles. Data can be generated for
departments, bureaus, divisions, and even down to individual offices or
individual supervisors. Reports can be viewed in MS Word, MS Excel, or
HTML. This application does not currently have the 2-standard deviation
methodology. The company is based in
Icomplaints, which is used by more than
75 federal agencies, provides all the capabilities needed to manage, track and
report on EEO cases. It is compliant with EEOC’s MD-110 and provides a
complete set of data elements and on-screen formatting required for EEO Form
462. It is also capable of generating the No Fear Act postings for the
complaints information.
Among their larger clients
are USPS, USDA, DOJ, DOT, DOI, the U.S. Navy, the U.S. Army, Dept of
Energy, Dept of State, SSA, and National Science Foundation.
